General terms and conditions

1. Definitions

1.1. These General Terms & Conditions apply to all services, offers, agreements, and deliveries provided by Barbara Blazevic Photography.
1.2. The term “Client” refers to any individual or entity who has entered into an agreement with the photographer and accepted these terms.
1.3. The “Photographer” refers to Barbara Blazevic Photography.

2. Booking & Payment Terms

2.1. A 50euros non refundable deposit is required to confirm and secure your booking. The remaining balance must be paid before the delivery of the final photos.
2.2. Final photos will only be delivered once the full payment has been received.
2.3. Payments are made via bank transfer or another agreed-upon digital method.
2.4. Failure to complete payment may result in the cancellation of the delivery with no refund of the deposit.
2.5. Newsletter discount: newsletter subscribers receive a personal discount code in the welcome e-mail, giving 10% off the package price of their first photoshoot. The code is personal, valid once per person, for new clients only, and cannot be combined with other discounts. The deposit stays the same; the discount is deducted from the remaining balance.

3. Cancellations, Rescheduling & Delays

3.1. I believe that flexibility is part of the creative process, but to respect everyone’s time, cancellations must be made at least 48 hours in advance.
3.2. Cancellations made later or no-shows on the day of the session will be charged in full.
3.3. In the case of bad weather or unforeseen events, I may reschedule the session to ensure the best possible results.
3.4. Clients arriving more than 30 minutes late without notice may forfeit their session, with no refund of the deposit.
3.5. Sessions may be paused or ended if the welfare of dogs is at risk or if the animal appears unwell or mistreated.

4. Artistic Vision & Delivery

4.1. By booking a session, the Client acknowledges and agrees to the Photographer’s editing and artistic style.
4.2. I cannot guarantee that every moment or expression will be captured, especially when working with animals or children.
4.3. The Photographer will select and edit the final images. Requests for extensive or custom retouching may incur an additional fee.
4.4. Edited images are delivered within 3–4 weeks, unless otherwise communicated in writing.
4.5. RAW files or unedited images are not available for delivery.

5. Copyright & Usage

5.1. All photographs remain the intellectual property of the Photographer.
5.2. Clients may share their purchased digital images for personal use (e.g., social media, personal websites), provided proper credit is given to the Photographer.
5.3. Commercial use, entry into contests, or publication of the images requires written permission.
5.4. Clients may not edit the photos in any way: no altering, cropping, applying filters, removing watermarks or using the photos in collages. If you have any wishes for a photo, please contact the Photographer.
5.5. The Photographer may use the photos for the Photographer’s own commercial purposes, such as portfolio, website, social media, advertising and printed materials. This does not apply to photos featuring children (minors under 18), photos with explicit content, or when an additional written agreement has been made with the Client.
5.6. It is not allowed to use any kind of AI service or tool with the photos: not to edit, alter, enhance or generate images from them, and not to train AI models. If you have any wishes for a photo, please contact the Photographer.

6. Client Responsibility & Liability

6.1. Clients are responsible for themselves, their belongings and their pets during the session.
6.2. Clients must ensure dogs are under control at all times. The Photographer is not liable for the behavior of animals during the shoot.
6.3. If equipment is damaged by a client or pet, the Client is responsible for covering the full replacement value.
6.4. In the event of any damage, the maximum liability of the Photographer will be limited to 50% of the total booking value paid by the Client.
6.5. The Photographer is not responsible for dissatisfaction due to choices made by the Client (e.g., outfits, grooming, visible weather conditions).
6.6. The Photographer is not liable for any damages to personal property, clothing or other items during the session.
6.7. By booking a session, the Client agrees to indemnify and hold harmless the Photographer from any claims, damages or expenses arising from the Client’s failure to comply with these terms, including responsibility for the behavior of animals or other individuals present during the session.

7. Complaints, Data Protection & Privacy

7.1. Any complaints must be submitted in writing within 7 days after delivery of the final images.
7.2. By booking a session, the Client agrees to the use of their personal data for the purposes of communication, invoicing, and service fulfillment. All personal information will be treated confidentially and in compliance with the General Data Protection Regulation (GDPR) and the Dutch Data Protection Act (AVG).
7.3. The Photographer respects your privacy and ensures that your personal data, such as name, contact details and payment information, is used solely for the purposes of fulfilling the agreed-upon services and will not be shared with third parties unless necessary (e.g., payment processing, printing, or delivery services).
7.4. The Client has the right to access, correct or request the deletion of their personal data at any time by contacting the Photographer directly.
7.5. The Photographer takes all reasonable measures to ensure that your personal data is securely stored and processed according to applicable data protection laws.

8. Gift Vouchers

8.1. Gift vouchers (cadeaubonnen) are sold on fotobarbara.nl for an amount chosen by the buyer and are paid online through the payment provider Mollie. The voucher is sent by e-mail as a PDF with a personal code.
8.2. A gift voucher is valid for 2 years from the date of purchase; the expiry date is printed on the voucher. After that date it can no longer be used.
8.3. A gift voucher can be used for any photoshoot with the Photographer in the Netherlands, including the deposit and extra photos, by entering its code when booking. It can be used in parts until the amount is spent; any remaining amount stays available until the expiry date. Gift vouchers are not valid for photoshoots booked through fotobarbara.hr.
8.4. A gift voucher cannot be exchanged for cash, and no change is given. It can be combined with the newsletter discount; the discount is calculated on the package price before the voucher is deducted.
8.5. Right of withdrawal: the buyer may cancel a purchased gift voucher within 14 days of purchase without giving a reason, as long as it has not been used, by e-mailing info@fotobarbara.nl. The full amount is refunded within 14 days through the original payment method.
8.6. Whoever presents the code may use the voucher. The Photographer is not responsible for a lost, stolen or shared code; a lost voucher can be sent again to the buyer’s e-mail address.

9. Governing Law

9.1. All agreements and services provided by the Photographer are governed exclusively by the laws of the Netherlands.
9.2. In the event of a dispute that cannot be resolved through mutual agreement, the matter shall be submitted to the competent court in the jurisdiction where the Photographer is established.
9.3. By booking a session, the Client agrees to these terms and conditions and acknowledges that they have been made available prior to confirmation.
